Law career for rights and duties : Career in Law and Legal studies Nepal

“I was always interested to learn about policies and constitution. So I chose the profession of a lawyer and I’m satisfied with my decision,” says Advocate Saroj Pyakurel.

After years of experiences in the field, Pyakurel says that the profession has turned him into an independent and aware citizen who now knows a lot about handling issues related with law. “As a lawyer, I’ve dealt with social and political issues as well as criminal and family issues,” he shares.

“For youngsters, too, studying and practicing law is beneficial at personal as well as professional level,” he observes. Law students can grow up to be stronger persons who can apply their knowledge and skills in different sectors that enhance the development of the nation, he says.

Similarly, Advocate Ashish Adhikari, who is also a Professor at Kathmandu School of Law (KSL) in Bhaktapur, says that in the present world, lawyers are in demand in many sectors.

“After hard work and practice, lawyers tend to possess attributes like strong communication and presentation skills as well as argument skills,” he shares. They also develop analytical skills that make them capable of tackling many serious issues, he adds.

And he emphasizes that law students have many opportunities as they can choose from a range of sectors after acquiring a license of a lawyer. “For instance, in the government sector, one can go for the foreign affairs, or work with law firms and courts,” he observes. They are also hired in the private organizations as advisors and in-house corporate lawyers, he adds.

Irada Pahadi, who has a Master’s in Journalism and an undergraduate degree in Law, has been working with Ganapati Law Firm in Dilli Bazaar for six months now.
“There weren’t many female lawyers earlier, which was what encouraged me the most to go for the profession,” she says.

“Every citizen should be aware about the laws and constitution of one’s country,” she says. This hunger for knowledge on rules and regulations of the country also attracted her in the profession, she adds.

She observes that people aren’t aware about the rights and duties that are integral parts of one’s own profession, either. This disheartens her and she suggests people should make it a point to have a thorough knowledge about their rights and the existing laws of the country.

About her experiences so far, Irada shares that one has to struggle a lot to establish oneself as a good lawyer. But once one is established and maintains a good PR, the work will get easier.

Regarding the improvement that needs to be brought in the field of law in Nepal, she says, “There are thousands of cases that haven’t been solved in the Supreme Court. This is happening due to the inefficiency of the system and probably due to the lack of more skilled lawyers in the court.” She suggests that this should be checked.

Likewise, Advocate Adhikari says that while preparing students for legal career, they should be provided with more practical knowledge.

“The course should be revised. Students should be asked to analyze as many cases as possible and that too from a variety of issues, ranging from business to social sectors,” he suggests.

The examination conducted by Nepal Bar Council also needs revision, he observes. He informs that the Council issues license to law students after passing a written examination. “But it would be better if the students first practiced with established law chambers and firms for some months and then only go for a full-fledged license,” he recommends, adding that studying law does have a bright prospective.

You can either join LLB after acquiring a Bachelor’s degree in any other discipline or go for a five-year law course directly after completing high school.

    What after SLC?

The result of the School Leaving Certificate (SLC) exams showed that 43.92 per cent students got through the Iron Gate. Now it is time for these successful students to join colleges for higher education. During their search for colleges, some students tend to follow their friends, some seek help from parents, seniors, friends or teachers. And colleges advertise their facilities while offering different kinds of discounts. Therefore, students should be cautious while choosing colleges so that they don’t make wrong choices and regret in the future.

    Excited students, their aspirations
Alish Basnet and Ashish Ghimire graduated from Mount Glory English Boarding High School, Tahachal this year.

Excited about their higher studies, they have decided on the subject and college to study. “I am going to study Computer Science as this era is all about computer technologies,” shares Basnet, who is motivated by his elder brother’s IT store to study this subject.

“Determined” about his choice, Basnet claims, “It’s the 21st Century and I feel there is more scope in computer technology than other fields. Meanwhile, I am also good at subjects like Maths, Accounts and Social Studies.”

Ghimire, who has decided to join the Science stream with the guidance of his parents expresses, “There is good scope for those studying Science and after +2, I am going to go into the engineering field.”

Another SLC graduate, Dipendra Tamang from Nepal Adarsha Secondary School, Ganabahal, is interested in cooking lessons and is opting for Hotel Management course.

He shares, “I have knowledge of cooking and I am also interested in the hospitality industry. Meanwhile, my tuition teacher has suggested me to join college with Hotel Management course.”

But not all students are sure about the subjects and colleges they wish to study in. Some of them are still confused and Anisha Pokhrel is one of them. The SLC graduate from Shree Saraswati Niketan Secondary School, Bhramatole opines, “My seniors have suggested me to study Hotel Management and I almost got tempted to study that. But I am interested to study Chartered Accountancy (CA). I have told my parents about my interest. Though I was in a dilemma before, now I am sure I will join CA after my +2.”

    Before choosing college
After deciding which subject to study, you need to find the right college. There are certain criteria while choosing a perfect college where Educationist Dr Mana Prasad Wagley explains, “The first thing students must inquire about is the teachers and should opt for colleges having full-time teachers. Then students should look for availability of extracurricular activities like music, dance et cetera. Finally look for IT facilities such as wi-fi and proper computer lab.”

Having full-time teachers means the teachers can give full attention to the students, as per Wagley. And extracurricular activities help in their physical and mental development.

But how would one know about the college? He advises, “Before joining a college, consult senior students who are studying in that college. If the students keep these things in mind, they will be able to secure a good educational life and won’t regret later.”

Dissatisfied with the information she got from a few colleges, Manzita Khadgi, who passed SLC exams from Shree Saraswati Niketan Secondary School opines, “I wanted to study Management course with Computer Science. Though I visited a few colleges, I am not getting enough information about the course. I am little disappointed as there is no one to help me out and clear my confusions related to the subject as I am the first child of my parents.”

Dr Wagley finds the problem in the “market that is full of unhealthy competition. In addition, most parents do not inquire about the colleges before sending their children and even our schools do not counsel the students about opting for a college or subject.”

To tackle such problems, he advises, “Students should opt for the course according to the marks obtained and as per their interest. They should keep in mind about their parents’ financial condition too. Parents should at least ask other parents whose children are studying in that particular college and take their suggestions before admitting their own children in any college.”

However, one needs to be cautious like Khadgi while taking others’ advice. Khadgi reveals, “My friends forced me to join Science stream but I know my aim. So I am not joining with them as it is about my future and my decision. It is better not to regret the choice later.”

SAIM College MBA-Global Business Pokhara University Admission Notice, Application Form,Entrance Date

South Asian Institute of Management (SAIM) announces admission open for MBA (Global Business) program affiliated to Pokhara University for Fall 2014.

    About MBA (Global Business)
MBA (Global Business) is designed with the objective of preparing managers who are well-conversant not only with the latest managerial concepts, tools and techniques but also with the global and regional trends in business so that they can take up the challenges of leading and managing their organizations by building competitive edge in the global and regional context.

The program deals with social, economic, political and cultural issues that affect the way business is conducted around the world. The traditional, general MBA programs deals more with decision-making tools and functional areas and provides little exposure to global trend and management practices. Such MBA graduates tend to be too general and lack confidence to operate in the global environment.

    Eligibility:
Anyone having a bachelor degree or equivalent with 15 years of formal education (12 years of schooling and three years of graduation) in any discipline with minimum 45 percent of the aggregate marks or 2.0 Cumulative Grade Point Average in undergraduate level can apply for admission to MBA (Global Business).

Admission to the program is based on academic promise of applicants as indicated by their academic records, statement of objectives, recommendations, scores on entrance test and performance in the personal interview and group discussions.

Last Date for Application Submission :25 June, 2014 (Wednesday)

Application forms for MBA can be obtained from SAIM College or downloaded from SAIM website.

    Systemic failure: SLC results

It won’t be wise to read too much into this year’s SLC pass percentage in isolation. But the pass rate of 43.92 percent (173,436 of 394,133 examinees), although a slight improvement on last year’s 41.57 percent, is still hard to digest. Officials at the Office of Controller of Examinations (OCE) attribute the steadily declining pass percentage over the last few years to stricter supervision.

The recent results are in sharp contrast to bumper harvests of 2009 and 2010, when 68.47 and 64.31 percent regular examinees cleared the exams. Yes, incidents of blatant cheating like family members of the examinees passing on chits by bribing invigilators have gone down and this might have had a significant impact on the final results. But if that is the case, the situation is more worrisome. To have nearly 60 percent of students fail despite the billions pumped into school education cannot be justified. Interestingly, after the even more dismal results last year the Department of Education had promised a ‘double-digit rise’ in pass percentage and had introduced a 15-point reform plan. We are not convinced that promising a certain number of students will pass is a wise thing to do: how would you ever know for sure? In the end, the eventual results speak for themselves.

Arguably, the entire public schooling system has failed. While 93.25 percent of students from private schools cleared the exams, just 29.19 percent from public schools did. What is perhaps the most alarming (but again not surprising) is the alarming increase in failure rates in mathematics and science, the subjects that are considered vital in students’ intellectual development and future career prospects. There has been no shortage of remedial measures that have been proposed at various times. One such proposal is that questions should only be asked from Grade X books. (The high success rates in 2009 and 2010 were achieved when SLC questions covered only Grade X curriculum.) But that would be an insincere fix. We rather need to work at improving the quality of our public school teachers and creating an environment that fosters learning at school. Quick fixes like the 15-point plan, as the results prove, are unlikely to work. It says a lot about our school system that only around 10 percent of all students who enroll in primary schools go on to clear SLC exams.

A better way to improve the SLC pass percentage would be to give weight to year-round progress, calculated on the basis of regular attendance, class participation and home-works. One reason the private schools have a higher success rate is that there is a greater pressure on students to do well right through the academic calendar. There is also more teacher-student interaction at private schools. The current community school education system has a top-down model whereby the ‘knowledgeable’ teachers are expected to enlighten the ‘ignorant’ students. Our public school teachers should be trained to make the process more participative and to act more as facilitators of learning. For unless the students are motivated to learn, no one can teach them anything.

SLC 2070 2071 Toppers Boys Girls Male Female Highest Marks Percentage:Students who made it big in SLC

Though they always topped their class, they had never thought of becoming toppers in School Leaving Certificate (SLC) examinations.

“I was confident about securing over 90 percent. But I had never thought I would secure the highest marks in SLC examinations,” said an elated 17-year-old Sanjog Karki, a student of Reliance International Academy in Kapan. He has secured 94.12 percent in SLC exams.

Similarly, Drishti Giri, a student of Occidental Public School in Anamnagar, has always topped her class. “I knew I was going to secure the highest marks in my school as always. But I had not even imagined that I would be the SLC topper,” said the 15-year-old. She had expected to secure 92 percent in SLC. But she secured 94.12 percent.

Both the schools of the capital have claimed that their students, Sanjog Karki and Drishti Karki, have secured the highest marks in this year?s SLC examinations. Each of them has scored 753 out of 800 marks. As no school has so far made the claim, these two students might be the SLC toppers of this year.

“But my hard work has finally paid off,” said Giri, who studied at Occidental Public School right from the beginning.

She says she studied for more than eight hours every day to prepare for SLC exams. “I studied every day and revised my lessons periodically. I think this helped me score high,” said she.

However, Karki did not study regularly like Giri. “I made it my point to understand what teachers taught. But I never spent long hours studying my books,” says he, who is also a player of Handball from his school.

Khem Lal Bhusal, principal of Reliance International Academy, said Karki was highly interactive in his class. “He would ask questions and was hard working. We had high expectations from him in the SLC exams,” said he.

“Our teachers always tried to teach us how to read rather than what to read. So, I would browse the internet and collect study materials,” says Karki.

Giri and Karki want to study science in the higher secondary level. However, while Giri wants to be a doctor, Karki aims to be an aeronautical engineer.

Giri has secured 95 in English, 88 in Nepali, 99 in mathematics, 97 in science, 84 in social studies, 93 in health, population and environment, 98 in optional mathematics and 99 in computer science. Similarly, Karki has secured 90 in English, 88 in Nepali, 99 in mathematics, 94 in science, 91 in social studies, 92 in health, population and environment, 99 in optional mathematics and 100 in computer science.

Last year, Ashim Ghimire of Little Flower English School in Birtamod Jhapa had secured 93.62 percent and topped the SLC exams.

    About Ace MBA (evening)
The MBAe degree is for young aspirants who want to earn an MBA degree and gather work experience simultaneously. This program allows fresh graduates to work and study together without compromising on either. The program accommodates the need to learn and earn together.

The program is similar to the regular MBA. On completion of the program, the student will be conferred the Masters in Business Administration (MBA) degree by Pokhara University.

The main differences in MBA & MBAe are:
    > Minimum time of completion: 32 months spread over 8 trimesters. Since the participants’ need is to learn and work together, the 32-month period will allow participants to settle in their jobs as well as put the required effort to earn a degree without compromising on the learning. In this way, the participants are not over burdened with the rigors of the program and also have the required time to withstand the pressures of a new job.
    > Corresponding study plan: The study plan accommodates the learning needs of the participants and the minimum time of completion. It ensures that the participants are not overloaded with course work and therefore will not be compromising on their acquisition of knowledge and skills.
    > Class timings: 6:00 pm – 8:30 pm, 6 days a week (Sunday-Friday)
    > Examinations: The participants of the MBAe program will take the same examination as the MBA regular students conducted by the university.
